Ipswich company back-pays truck driver

$33,000 after pay protector steps in


The national pay protector has recovered $33,000 for an Ipswich truck driver.


The truck driver lodged a complaint with the Fair Work Ombudsman after he

became aware he was being underpaid the minimum hourly rate and overtime.


Fair Work inspectors investigated and contacted the truck driver’s employer to

educate it about its obligations under workplace laws.


The driver was promptly reimbursed money owed to him without the need for

further action against the company.


Fair Work Ombudsman Queensland Director Julie Wade says the employer

avoided prosecution by fully co-operating with inspectors and voluntarily

rectifying the underpayments.


“Our preference is always to work with employers to educate them and help them

voluntary rectify any non-compliance issues we identify,” she said.


“However, employers must be aware that it is their responsibility to ensure they

are aware of which Awards apply to their employees and that they pay staff

correctly.


“If we do take matters to court, fines of up to $33,000 per breach of workplace

laws can be applied.”  


Ms Wade says the Fair Work Ombudsman can help workers and employers to

understand recent changes to Australia’s workplace relations laws, including the

minimum rates of pay which should be paid to employees.
