Court orders Ararat man to back-pay two
Stawell security guards
An Ararat man whose former security firm underpaid two employees almost
$18,000 has been ordered to pay the money back.
The order has come from the Magistrates Court of Victoria following legal action
initiated by the Fair Work Ombudsman.
Raymond Timothy Parmenter has been instructed to back-pay two full-time
security guards whom he underpaid between 2006 and 2008.
The men worked for Parmenters sole-trader RHTC security business as static
security guards at the gatehouse of the Stawell Gold Mine.
Parmenter has been told to reimburse the men amounts of $16,770 and $1040
respectively, plus interest.
He must pay weekly instalments of $25 until he has fully rectified the lesser
underpayment and then make weekly payments of $50 until the second worker is
repaid in full.
Parmenter admitted the underpayments and agreed to a back-payment plan in
return for the Fair Work Ombudsman not seeking a penalty against him.
Fair Work Ombudsman Executive Director Michael Campbell says the outcome is
the best possible result for the underpaid workers.
Parmenter is bankrupt and it would have been very difficult to enforce any fine
and back-payment order imposed on him without his co-operation, Mr Campbell
said.
The Fair Work Ombudsman promotes harmonious, productive and co-operative
workplaces. It also monitors compliance and investigates breaches of national
workplace laws.
