Perth business fined for failing to provide

employment records

A

Perth financial services business and its director have been fined a total of

$4620 for failing to provide time-and-wages records for former employees who

claimed they had been underpaid.

SRS Investments (WA) Pty Ltd - which trades as SRS Business Solutions and

Cavill Business Solutions - has been fined $3850.

The company’s sole director and shareholder, Sara Rhiain Sandford, of Carine,

was penalised a further $770.

Federal Magistrate Toni Lucev imposed the fines in the Federal Magistrates Court

in Perth after finding they failed to comply with requests from the Fair Work

Ombudsman to provide employment records.

Fair Work inspectors requested time-and-wages records for four former

employees of SRS Investments who complained they had been underpaid - but

the company only provided records for one of them.

“The failure to provide the records has involved a deliberate course of subterfuge

by SRS Investments and Ms Sandford,” Federal Magistrate Lucev said.

Delivering his judgment, Federal Magistrate Lucev said there was a need to

impose a penalty to “mark disapproval of the conduct in question and act as a

warning to others not to engage in similar conduct”. 

Fair Work Ombudsman WA Director Leigh Quealy says that under the Fair Work

Act, employers must comply with requests from inspectors to provide time-and-

wages records.

“We will prosecute companies and individuals who fail to supply the records we

need to complete our investigations,” he said.

The Fair Work Ombudsman promotes harmonious, productive and co-operative

workplaces. It also monitors compliance and investigates breaches of national

workplace laws.
